The Eastern Regional Fisheries Board has successfully won a court case against Cavan County Council for a water pollution offence. The Council was fined €500 and ordered to pay total costs of €4,000 to the Board in Bailieborough District Court on 4th September last.
On 22nd February, fisheries personnel responded to a report of pollution from a waste water treatment plant at Corgarry in Kingscourt, Co. Cavan. Upon inspection water samples were taken at the Cormey river which is a tributary of the River Glyde and is an important salmon river in the area. Cavan County Council pleaded guilty to failing to protect waters from pollution and Judge Sean McBride convicted Cavan County Council under Section 172(2)(a) of the 1959 Fisheries Act.
Judge McBride said there was no evidence of a fish kill and immediate steps were taken by the Council to fix the problem. He therefore imposed a fine of €500 for the pollution and costs of €4,000 with 2 months to pay and said it was unlikely to happen again before a new waste water treatment system is put in place in the future.
